- Section 3 of The Privacy Act (R.S.C., 1985, c. P-21) shall be amended under the definition of
- “personal information.”
- Section 3(n) shall be added which reads: “Information related to biorhythms or neurological
- patterns.” The Criminal Code will be updated to include a law against the collection of neurological
- patterns or biorhythmic data without the consent of the individual, with a special focus on
- espionage, blackmail or political manipulation.
- The Criminal Code will be updated with reference to s. 7 and s. 8 of the Charter of Rights to
- Freedoms to protect citizens from unreasonable search by law enforcement using techniques to collect
- biorhythms or neurological patterns, especially when they have an expectation of privacy.
- A committee will be convened to created a comprehensive framework for NeuroPrivacy Rights, as well
- as a plan for regulating technologies that can breach NeuroPrivacy Rights.

G23-P020 La loi-cadre sur la protection de la vie privée et des données biologiques (NeuroPrivacy and BioData Framework Act)
L'article 3 de la Loi sur la protection des renseignements personnels (L.R.C., 1985, ch. P-21) est modifié sous la définition de "renseignements personnels".
L'alinéa 3n) est ajouté et se lit comme suit : "Les renseignements relatifs aux biorythmes ou aux schémas neurologiques. Le Code criminel sera mis à jour pour inclure une loi contre la collecte de schémas neurologiques ou de données biorythmiques sans le consentement de la personne, en mettant l'accent sur l'espionnage, le chantage ou la manipulation politique.
Le Code criminel sera mis à jour en référence aux articles 7 et 8 de la Charte des droits à la liberté d'expression et d'association. 8 de la Charte des droits et libertés afin de protéger les citoyens contre les fouilles abusives effectuées par les forces de l'ordre à l'aide de techniques de collecte de biorythmes ou de schémas neurologiques, en particulier lorsqu'ils ont une attente en matière de vie privée.
Un comité sera mis sur pied afin de créer un cadre global pour les droits de neuroprivité, ainsi qu'un plan de réglementation des technologies qui peuvent enfreindre les droits de neuroprivité.
